PRIVACY POLICY

This policy explains what personal data Shambala collects through this website, why, and what you can do about it. We collect as little as we need to answer your enquiry and help you find a property.

Shambala (“we”, “us”) is a real-estate agency in Phuket, Thailand, run by its founder, Michael. We are the data controller for the information described here and handle it in line with Thailand's Personal Data Protection Act B.E. 2562 (2019) (“PDPA”).

What we collect

When you send an enquiry through the contact form, we receive:

  • your name and email address;
  • your phone or WhatsApp number, if you give it;
  • what you are interested in (renting, buying, selling, property management or a general question), the property you are asking about, if any, and your message.

What we don't collect

  • We don't use advertising, analytics or tracking cookies, and we don't build profiles of visitors.
  • Saved (favourite) properties and your language choice are stored only in your own browser (local storage and a small “lang” cookie). They are never sent to us, and you can clear them at any time in your browser settings.
  • Like almost every website, our hosting provider automatically records basic technical data (such as IP address, browser type and the pages requested) in short-lived server logs, for security and to keep the site running.

Why we use it

We use your enquiry only to reply to you and to help with the property matter you contacted us about: arranging viewings, sending details of suitable properties and guiding you through renting or buying. Our legal basis is your request to us and the steps needed before any agreement with you (PDPA section 24(3)), and our legitimate interest in answering enquiries (section 24(5)).

We never sell your data or use it for unrelated marketing. We will only send you newsletters or offers if you ask for them.

Who we share it with

Your data is handled by a small number of service providers that make the website work. They process it on our behalf and only for these purposes:

  • Supabase: stores enquiries in a secure database (Singapore region).
  • Vercel: hosts and delivers the website.
  • Telegram: delivers a notification of each new enquiry to our founder's private chat so we can reply quickly.

If you choose to contact us on WhatsApp or by email, that conversation is also subject to WhatsApp's or your email provider's own privacy policies.

With your agreement, we may pass your details to people directly involved in your transaction, such as a property owner, developer or lawyer. We will also disclose data if the law requires it.

International transfers

Some of these providers store or process data outside Thailand, for example in Singapore, the United States or the European Union. We use established providers that apply appropriate security and data-protection safeguards.

How long we keep it

We keep enquiries for as long as we are in contact with you about a property, and then for up to 24 months so we can pick up the conversation again or answer follow-up questions. After that we delete them, unless the law requires us to keep them longer. You can ask us to delete your data sooner at any time.

Your rights

Under the PDPA you have the right to:

  • ask for a copy of the personal data we hold about you;
  • have inaccurate data corrected;
  • have your data deleted, or its use restricted;
  • object to how we use it, and withdraw any consent you have given;
  • receive your data in a portable format;
  • complain to Thailand's Personal Data Protection Committee (PDPC).

Security

Enquiries are sent over an encrypted (HTTPS) connection and stored in a database that only the site owner can access. No system is completely secure, but we take reasonable steps to protect your data.

Children

This website is not aimed at children, and we do not knowingly collect data from anyone under 18.

Changes to this policy

If we change how we handle personal data, we will update this page and the date at the top.
